Monument protection and preservation

If you want to build, you need to know whether your building plans can be realized on your property due to building regulations and monument protection requirements. The building inspection department will advise you on how you can realize your building plans.

Initial important basic information can be found in the development plans of the town of Bad Homburg v. d. Höhe. If it is not possible to find the necessary answers in the verbal consultation, you have the option of having these answers legally answered as part of a formal preliminary building application.

  • Listed buildings - Applying for changes - Legal basis

    The aim of monument protection is to preserve the original building fabric and the historical appearance of cultural monuments as far as possible. You therefore require a listed building permit for construction work on cultural monuments*

    In addition to individual buildings, overall structures whose appearance is of particular public interest are also protected. This applies above all to streetscapes, squares and townscapes.

    If you intend to make changes to the protected appearance of an entire complex, you will need the approval of the lower monument protection authority.

    Documents

    Depending on the individual case, you will need to submit various documents, for example

    • Site plan of the property
    • Plan documents (floor plans, views, sections) of the property
    • detailed description of measures with material specifications and structural details or
    • Preliminary investigations and expert reports from specialists (e.g. from the fields of restoration, carpentry restoration, statics, geology)
    • Survey form for the statistics on construction activity in building construction (building permit - construction backlog - construction completion or demolition - demolition - change of use) in duplicate

    Tip: Contact the lower monument protection authority at an early stage. They will tell you which documents are required for your approval procedure.

    Fees

    If a building permit is required, fees will be charged. Enquire directly with the responsible authority.

    Processing time

    There are no statutory deadlines within which you must apply for approval. However, you may not start construction work until you have the permit. This also applies in cases where you do not require planning permission.

  • Monument preservation

    The historically evolved cultural landscapes, cities and towns provide us and future generations with opportunities to develop individually and identify with the land. They are a piece of home.

    Preserving this cultural heritage, a testimony to our history, is also the task of the state. This is enshrined in Article 62 of the Hessian Constitution. The Hessian Monument Protection Act is decisive for this in everyday practice.

    This obligation of the state also means that it intervenes in questions of monument preservation. It fulfills its responsibility by protecting monuments from inappropriate changes that destroy their historical value. It helps monument owners to bear the additional costs of preserving cultural monuments through tax relief and financial grants, and it advises them on professional preservation.

    This has a long tradition in Hesse. As early as 1902, the Grand Duchy of Hesse enacted one of the first modern monument protection laws. Since 1974, there has been a uniform monument protection law for the whole of Hesse, which is still in force today in its amended form from 1986.

    The preservation of monuments is mainly divided into

    • Preservation of architectural monuments
    • Preservation of archaeological monuments - it deals with archaeology and palaeontology (fossils)

  • Apply for listed building approval

    Monument protection is intended to preserve the original building fabric and the historical appearance of cultural monuments as far as possible. Buildings are cultural monuments if their preservation is important for

    • scientific or
    • artistic reasons

    public interest for scientific or artistic reasons.

    Do you want to carry out measures on a cultural monument that interfere with its substance or change its appearance? You will always need a permit from the lower monument protection authority - regardless of whether you need planning permission for your project or not. If planning permission is required, the building authority will contact the lower monument protection authority on its own initiative.

    You may only start the building work once you have the permit.
